AGREEMENT TO OUR LEGAL TERMS
We are Folsom Wrap & Detail LLC ("Company," "we," "us," "our"), a company registered in California, United States, at 14851 Sun Peak Drive, Folsom, CA 95630. We operate the website folsomwrapdetail.com (the "Site"), as well as related products and services including vehicle wrapping, paint protection film (PPF), ceramic coatings, detailing, window tinting, and other automotive services that refer or link to these Legal Terms (collectively, the "Services"). These Legal Terms constitute a legally binding agreement between you and Folsom Wrap & Detail LLC. By accessing or scheduling Services, you confirm that you have read, understood, and agree to be bound by these Legal Terms. If you do not agree, you must discontinue use immediately. Supplemental terms or documents posted on the Services are incorporated by reference. We may modify these Legal Terms at any time, effective upon updating the "Last updated" date. You are responsible for reviewing updates periodically. Continued use constitutes acceptance of the revised terms. The Services are intended for users at least 18 years old. 1. OUR SERVICES The Services include, but are not limited to: • Color Vinyl Wrap, Chrome Delete, and Wrap Removal • Color and Clear Paint Protection Film (PPF) • Ceramic Coatings (Quick, Pro, Lifetime) • Full, Exterior, and Interior Detailing (with Add-Ons) • Window and Head/Taillight Tinting • Windshield Skin, Chip Repair, and Glass Scratch Removal • Polishing Services Information provided through the Services is not intended for distribution or use where prohibited by law. Users accessing the Services from other locations are responsible for compliance with local laws. 2. INTELLECTUAL PROPERTY RIGHTS Our Intellectual Property We own or license all intellectual property rights in the Services, including source code, databases, functionality, software, website designs, audio, video, text, photographs, graphics (collectively, "Content"), and trademarks, service marks, and logos (the "Marks"). These are protected by U.S. and international copyright, trademark, and other intellectual property laws. Content and Marks are provided "AS IS" for personal, non-commercial use or internal business purposes only. Your Use of Our Services Subject to compliance with these Legal Terms, including the "Prohibited Activities" section, we grant you a non-exclusive, non-transferable, revocable license to access the Services and download or print Content for personal, non-commercial use or internal business purposes. No part of the Services, Content, or Marks may be copied, reproduced, or exploited commercially without our express written permission. Requests for such use should be sent to team@folsomwrapdetail.com. Your Submissions By submitting questions, comments, suggestions, or feedback ("Submissions"), you assign us all intellectual property rights in such Submissions for unrestricted use without compensation. You confirm that Submissions are original or properly licensed, not illegal or harmful, and you are responsible for any losses we incur due to your breach of this section. 3. USER REPRESENTATIONS By using the Services, you represent and warrant that:
- You have legal capacity and agree to comply with these Legal Terms.
- You are not a minor in your jurisdiction.
- You will not access the Services through automated or non-human means.
- You will not use the Services for illegal or unauthorized purposes.
- Your use of the Services will not violate applicable laws.
Providing untrue or inaccurate information may result in suspension or termination of your access to the Services.
4. PRODUCTS AND SERVICES We strive to accurately display the colors, features, specifications, and details of products and Services. However, we do not guarantee accuracy, completeness, or availability. Products and Services are subject to change or discontinuation at our discretion, and prices may vary. Specific Services are detailed in Section 9 (Service-Specific Disclosures). 5. PURCHASES AND PAYMENT Accepted Payment Methods We accept:
- Visa, Mastercard, American Express, Discover
- Stripe, PayPal, ACH, Affirm, Afterpay, Klarna
You agree to provide accurate purchase and account information and to update it promptly. Sales tax will be added as required. A 50% non-refundable deposit is required to schedule appointments, with the balance due at vehicle pickup. Deposits may be transferred to a rescheduled appointment within 14 days. We reserve the right to correct pricing errors, refuse orders, or limit quantities at our discretion.
6. SUBSCRIPTIONS Billing and Renewal Subscriptions continue and auto-renew unless canceled. You authorize recurring charges without prior approval until cancellation. The billing cycle depends on the chosen plan. Cancellation Cancel subscriptions by contacting us at team@folsomwrapdetail.com. Cancellation takes effect at the end of the current paid term. Fee Changes We may adjust subscription fees, with notice provided per applicable law. 7. RETURN AND REFUND POLICY Completed Services are non-refundable. Prepaid Services canceled more than 72 hours in advance may receive a refund minus a 3% processing fee. No refunds are issued for cancellations within 72 hours of the scheduled appointment. Deposits are non-refundable but transferable within 14 days. 8. WARRANTY COVERAGE Installation Warranty We provide a 1-year warranty for defects (e.g., lifting, peeling, bubbling, adhesion issues) on vinyl wrap, tint (including lights), PPF, ceramic coatings, and windshield protection installations, provided failure is not due to improper maintenance or customer-supplied products. Product Warranty Manufacturer warranties (typically 5–12 years) apply to vinyl film, PPF, ceramic coatings, and tint products. We assist with claims but cannot guarantee approval. 9. SERVICE-SPECIFIC DISCLOSURES Vinyl Wrap / Chrome Delete / Wrap Removal • Films are applied using industry best practices, but removal may reveal underlying flaws or require paint correction. • Vehicles with prior bodywork or paint may experience adhesion issues or surface irregularities. Paint Protection Film (PPF) • Clear PPF protects against chips and scratches; color PPF alters appearance. • Results depend on surface condition and prep. Prior paint/bodywork repairs may affect outcomes. Ceramic Coatings • Includes paint correction and decontamination before application. • Warranty requires maintenance: pH-neutral hand washing, avoiding harsh chemicals, and using maintenance toppers. Detailing (Full, Exterior, Interior + Add-Ons) • Includes wash, clay, vacuuming, and ceramic sealant. • Add-ons include odor/mold treatments, pet hair removal, seat shampoo, headlight restoration, etc. Window Tint & Light Tint • Minor particles or fibers may be visible under close inspection (industry standard). • Rear defroster lines may affect finish. Customers must comply with California tint laws. • Do not roll down windows for 72 hours post-installation. Exotic & Complex Vehicle Pricing Certain vehicles are classified as exotic or complex due to unique body shapes, frameless doors, or intricate glass and panel designs that increase labor time and material usage. These include (but are not limited to) the Tesla Model X, Volkswagen Beetle, Chevrolet Corvette (C7 & C8), Dodge Charger, Dodge Challenger, Mazda 3 Hatchback, Ford Mustang Fastback, and Honda Civic Hatchback. All exotic or specialty vehicles require a custom quote. Please contact us for vehicle-specific pricing before booking. Windshield Protection & Glass Services • Windshield skin, chip repair, and scratch removal preserve glass but do not restore pre-existing damage. • Imperfections may remain visible and are not caused by our process. Polishing Services • Enhances gloss and reduces imperfections, with results depending on paint condition and depth. 9.1 Service Limitations and Damage Disclaimer
Folsom Wrap & Detail provides all services with reasonable care, but certain services inherently carry risks due to the pre-existing condition of the vehicle. By accepting services, the customer acknowledges and agrees that:
1. Polishing and Paint Correction: We are not responsible for damage resulting from polishing, paint correction, or any procedure involving abrasion or removal of clear coat or paint layers, particularly where existing coatings, thin paint, prior repairs, or defects are present.
2. PPF, Vinyl, and Tint Removal: We are not responsible for damage that may occur during removal of paint protection film (PPF), vinyl wrap, window tint, adhesives, or coatings. Such removal may reveal pre-existing defects, clear coat failure, weak or repainted surfaces, or adhesive damage beyond our control.
3. Disassembly and Reassembly: Some services may require removal of trim, badges, mirrors, or panels. We are not responsible for breakage, clip failure, or damage resulting from removal or reinstallation of parts, especially where trim is aged, brittle, aftermarket, or previously repaired.
4. Vehicle Condition Disclaimer: We assume no responsibility for damage caused by defects, prior repairs, environmental exposure, aging, corrosion, or fragile components encountered during any service. Limitation of Liability: Our total liability for any claim is limited to the amount the customer paid for services within the preceding six (6) months. We disclaim all warranties, express or implied, including fitness for a particular purpose. By engaging our services, the customer accepts these risks and limitations.
10. CUSTOMER-SUPPLIED PRODUCTS No warranty is provided for customer-supplied films, coatings, or products. We may decline installation if products are expired, incompatible, or damaged. Labor is covered under our 1-year installation warranty, provided failure is not due to the product itself. 11. INSTALLATION AND MAINTENANCE Installation Disclaimers
- We avoid disassembling vehicle panels unless necessary for quality installation.
- If disassembly is required and the customer is unavailable, we may proceed with written consent preferred.
- We are not liable for damage to fragile clips, aged trim, or previously repaired panels during removal or reassembly.
Curing Periods
- Tint: 3–10 days (temporary bubbles/haze may appear).
- PPF: Settles within days; avoid high-pressure washes for 1 week.
- Ceramic Coatings: Avoid water for 24 hours; full curing in 7–10 days.
Cleaning Guidelines
- Wrap & PPF: Use pH-neutral soaps, soft mitts, and hand washing.
- Ceramic Coatings: Use coating-safe shampoos and toppers.
- Tinted Glass: Use ammonia-free glass cleaner and microfiber cloths.
Vehicle Drop-Off & Storage
- Remove personal belongings before drop-off; we are not responsible for lost or damaged items.
- Vehicles left beyond 48 hours after completion may incur a $25/day storage fee unless agreed otherwise.
- Vehicles are insured while in our care, custody, and control.
12. PROHIBITED ACTIVITIES
You may not use the Services for purposes other than those intended or engage in commercial endeavors without our approval. Prohibited activities include, but are not limited to:
- Systematically retrieving data to create collections without permission.
- Attempting to defraud, mislead, or bypass security features.
- Disparaging or harming us or the Services.
- Uploading viruses or engaging in automated system use (e.g., bots, scripts).
- Interfering with or disrupting the Services.
13. USER-GENERATED CONTRIBUTIONS
The Services may allow you to submit content (e.g., text, photos, reviews) ("Contributions"). Contributions may be viewable by others and are subject to our Privacy Policy. You represent that Contributions:
- Do not infringe third-party rights.
- Are accurate, not misleading, and not objectionable.
- Comply with applicable laws and these Legal Terms.
14. CONTRIBUTION LICENSE
We may access, store, and use Contributions per our Privacy Policy. You retain ownership of Contributions but grant us a perpetual, non-exclusive, worldwide, royalty-free license to use, modify, and distribute them. We are not liable for statements in your Contributions.
15. GUIDELINES FOR REVIEWS Reviews must:
- Be based on firsthand experience.
- Avoid offensive, discriminatory, or illegal content.
- Be truthful and not misleading.
- Not be posted by competitors or as part of organized campaigns.
We may accept, reject, or remove reviews at our discretion and are not liable for claims arising from reviews.
16. THIRD-PARTY WEBSITES AND CONTENT The Services may link to third-party websites or content. We are not responsible for their accuracy, appropriateness, or policies. Use of third-party websites or content is at your own risk, and purchases through them are solely between you and the third party. 17. ADVERTISERS We may allow advertisers to display ads on the Services. We provide the space but have no other relationship with advertisers. 18. SERVICES MANAGEMENT We may:
- Monitor the Services for violations.
- Take legal action against violators.
- Restrict or remove Contributions or content.
- Manage the Services to protect our rights and ensure proper functioning.
19. PRIVACY POLICY
Please review our Privacy Policy at https://folsomwrapdetail.com/privacy-policy. By using the Services, you agree to its terms. The Services are hosted in the United States, and you consent to data transfer and processing in the U.S.
20. TERM AND TERMINATION These Legal Terms remain in effect while you use the Services. We may deny access or terminate your use at our discretion, without notice, for any reason, including breach of these Legal Terms. If terminated, you may not create a new account under any name. 21. MODIFICATIONS AND INTERRUPTIONS We may modify or discontinue the Services without notice. We are not liable for interruptions, delays, or errors due to maintenance, hardware/software issues, or other causes. You agree we have no liability for any loss caused by Service downtime. 22. GOVERNING LAW These Legal Terms are governed by the laws of California, without regard to conflict of law principles. 23. DISPUTE RESOLUTION All disputes must first be submitted to our management for resolution. If unresolved, both parties agree to binding arbitration in Sacramento County, California. Legal actions must be filed in state or federal courts in Folsom, California, within one year of the cause of action. Our liability is limited to the value of the Service provided or remedy by rework, excluding consequential or incidental damages. 24. CORRECTIONS We may correct errors, inaccuracies, or omissions in the Services (e.g., pricing, availability) without prior notice. 25. DISCLAIMER The Services are provided "AS IS" and at your sole risk. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We are not liable for errors, personal injury, property damage, unauthorized access, interruptions, or third-party content. You should exercise caution and judgment when using the Services. 26. LIMITATIONS OF LIABILITY Our liability is limited to the amount you paid us in the six months prior to any cause of action. We are not liable for indirect, consequential, or punitive damages, including lost profits or data, even if advised of such damages. Some jurisdictions may not allow these limitations. 27. INDEMNIFICATION You agree to indemnify us, our subsidiaries, affiliates, and employees against any loss, damage, or claim arising from your use of the Services, breach of these Legal Terms, violation of third-party rights, or harmful acts toward other users. We may assume defense of such claims at your expense. 28. USER DATA We maintain data you transmit to manage the Services. You are responsible for your data, and we are not liable for its loss or corruption. Regular backups are performed, but you waive claims arising from data loss. 29. ELECTRONIC COMMUNICATIONS, TRANSACTIONS, AND SIGNATURES Using the Services, sending emails, or completing forms constitutes electronic communications. You consent to electronic communications and agree that they satisfy legal requirements for written communication. You agree to electronic signatures and records. 30. SMS TEXT MESSAGING Opting Out Reply "STOP" to opt out of SMS messages. You may receive a confirmation message. Message and Data Rates Standard rates may apply, determined by your carrier and plan. CALIFORNIA USERS AND RESIDENTS Unresolved complaints can be directed to the Complaint Assistance Unit of the California Department of Consumer Affairs at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by phone at (800) 952-5210 or (916) 445-1254. 32. MISCELLANEOUS These Legal Terms constitute the entire agreement between you and us. Our failure to enforce any provision does not waive it. We may assign our rights and obligations. We are not liable for delays or failures beyond our control. Unenforceable provisions are severable. No joint venture, partnership, or agency relationship exists between you and us. Legal Responsibility You are responsible for complying with state tint and customization laws. We are not liable for tickets, fines, or legal issues from customer-chosen modifications. 33. PAYMENT PROVIDERS Payment options through Affirm are subject to eligibility, may not be available in all states, and are provided by these lending partners: affirm.com/lenders.
